In 1861, at the age of 16, Marion enlisted in the Confederate Army for three months service. He served at Harper's Ferry for thirty days when his company was disbanded. In August, 1863, he again enlisted and served under General Fitzhugh Lee in Company K, 23rd Virginia Cavalry. (Inbodens Brigade, Gen. Lomax Division, Fitzhugh Lee's Core, Army of Northern Virginia). He served until the end of the war. He was engaged principally in the Campaign of Virginia Valley and took part in all the fierce battles fought over that ground. At the Battle of Winchester, he was riding a chestnut sorrel horse of which he was very fond. This horse was shot out from under him, but he captured another horse and again joined the fray, only to receive a flesh wound in the side a few minutes later. Two other horses were shot out from under him in subsequent engagements. He was honorably discharged from the Confederate Army at Richmond, Virginia. When he returned home there was nothing left but one crippled horse and a colt with which to start farming.1,2

Just after the Battle of Gettysburg, July 1-3, 1863, General Robert E. Lee and his army had camped at Emily's father's farm for six weeks after their retreat. Colonel John D. Gordon and his wife had boarded with the Paynes during their six week encampment.2

In 1883 Marion was a member of the West Virginia House of Delegates representing Martinsburg, Berkeley County.12 He was also President of the Board of Education from 1876 to 1886.2
On February 22, 1886, Marion moved his family to Wichita, Kansas.1,2 They left from Martinsburg, West Virginia, traveling over the Cumberland Valley Railroad, arriving in Wichita a few days later on February 25. They were met at the Wichita train station by Emily's brother, Adam Clarke Payne, with whom they stayed for three days until they purchased a farm of forty acres on Magic Hill (now the corner of Hillside and Harry Streets, Wichita).2

In 1901 they again moved to Goddard, Kansas, where Marion remained for the remainder of his life.1 He was engaged in the grocery business unti his retirement.2

Marion Lee Henshaw died Nov 13 1929, 2:13 PM, at the Wichita Sanitarium, Wichita, Sedgwick County, Kansas; age 84 years.1,2,8 Marion and Emily were married for sixty years without a death in the family, Marion being the first to go, He left his wife, eight children, twenty-one grandchildren, and ten great grandchildren.
Marion's obituary was published in 1929 as follows:15
His obituary goes on to explain that he was born in Bunker Hill, West Virginia, June 25, 1845 and was married to Emily B. Payne on October 19, 1869. They celebrated their 60th wedding anniversary 3 weeks prior to his death. He was prominent in the affairs of the Mill Creek district in West Virginia and one served as assemblyman in the state legislature. He moved to Wichita in 1886 and moved to the old Ten Mile trading post west of the city on the present Cannonball where he lived until 1901 when he moved to Goddard. Survivors are listed as his wife Emily and the following eight children: Holmes H. Henshaw, Hollywood, California; Carter Lee Henshaw, Tonkawa, Oklahoma; Myra A. White, Rogers, Arkansas; Minnie R. Harper, Mutual, Oklahoma; Valley V. Cook, Barclay; Daisy M. Mooberry, Goddard; Martin Pearl Henshaw, Twisp, Washington; Lilly W. Odgen, Goddard.

Marion Lee Henshaw, 84, Goddard, one of the few Confederate veterans in Sedgwick County, died in a local hospital Wednesday at 2:13 p.m. Mr. Henshaw first enlisted in the Confederate army in 1861 serving for 30 days at Harpers Ferry. He enlisted again in August, 1863, in Company K, Twenty-third Virginia cavalry, and served until the end of the war, taking part in most of the fierce engagements in the Virginia valley. While in the army Mr. Henshaw served under Gen. Fitzhugh Lee. He was wounded in the battle of Winchester. When the war ended he returned home with only a crippled horse and a colt to start farming.
